These conditions govern sales of paintings, prints... made exclusively by Pascal Boyart. They are accessible to the collector on this shop at the time of ordering.
1. LEGAL NOTICES Publisher: Pascal Boyart is on hand to advise you and answer your queries from Monday to Friday (excluding public holidays) – 10 am to 6 pm GMT+1, Paris time. By email: pascalboyart@protonmail.com
2. PRICES AND PAINTINGS Prices displayed are indicated in €, $ and Bitcoin – including all taxes (but excluding delivery costs for original works). Paintings or prints ordered will be invoiced at the price in effect at the time that the order is placed. With regard to orders from outside mainland France: you are the importer of the painting or print in question. For paintings or prints shipped outside the European Union, taxes are likely to apply. These taxes are in no way the responsibility of Pascal Boyart. They are payable by you and are your responsibility as much in terms of declarations as payments to the competent authorities and bodies in your country. The paintings or prints shall remain the full property of Pascal Boyart until receipt of the full price indicated.
3. ORDERING AND TRANSACTION APPROVAL When you confirm your order by clicking on the “confirm” button, you are declaring that you have read and accepted these general conditions of sale in their entirety. We reserve the right to cancel any order made by a collector with whom payment for a previous order is in dispute. The contract is binding upon confirmation of payment on Pascal Boyart's wallet.
4. PAYMENT Payment for your purchases shall be made in Bitcoin (BTC) or other main cryptocurrencies (Ethereum, Litecoin, Zcash, Monero...) and also by fiat €, $, via cash payment, or paycheck. Your order is shipped as soon as the payment is made by the collector.
5. DELIVERY Small artworks: 5x5" / 13x13 cm; 7x7" / 19x19 cm; 10x10" / 25x25 cm; 14x14" / 36x36 cm Orders placed prior to midnight (Paris time, GMT+1), from Sunday to Monday, excluding public holidays, shall be dispatched the following week. All works ordered together will be sent in a single package. Transit time after shipping is 3 to 7 working days in France and 7 to 30 working days for all other destinations. This time frame may vary depending on the destination country. Delivery will be made to the address indicated on the order form. The transfer of risk with regard to artworks purchased takes place at the time of their handover by Pascal Boyart to the carrier. Large size artworks: 20x20" / 50x50 cm and above. Orders for large-size works require a processing period of 7 to 15 days from payment. Delivery time after shipping is 3 to 10 working days in France and 7 to 30 working days for all other destinations. This timeframe may vary depending on the destination country. Delivery will be made to the address indicated on the order form. The transfer of risks with regard to artworks purchased takes place at the time of their handover by Pascal Boyart to the carrier. Reservations at the time of receipt of works It is your responsibility in the event of any shortcomings or damage, to inform the carrier of your reservations in a precise and detailed manner, writing “with reservations" on the delivery sheet, in order to take advantage of the contracted insurance policy. You must send a list detailing the damage to Pascal Boyart by email within 72 hours of delivery in addition to a copy of the form on which your reservations are indicated.
6. RIGHT OF REVOCATION: REIMBURSEMENT If you are not completely satisfied with your order, returning it is quick and easy. You have 30 days from receiving your order to return the product in its original packaging. You will be refunded the price of the product/s without the shipping costs and at the fiat price at the time you bought it. The return costs are the responsibility of the collector. Returned artworks should be sent back to Pascal Boyart on the sending adress specified on the package.
7. CONSUMER GUARANTEE In the event that works delivered present one or more hidden defects, send them to us in their original packaging and within 30 days of the delivery date.
8. RIGHTS TO THE WORK AND INTELLECTUAL PROPERTY The artist shall remain the owner of all copyright. The representation and reproduction rights to the works displayed on Pascal Boyart's shop belong to Pascal Boyart. Joint authorization from the above parties is required in order to exercise these rights. All items appearing on Pascal Boyart's shop are protected by copyright, trademark law and any other intellectual property rights. No reproduction and/or adaptation shall be made without the authorization of Pascal Boyart.
9. APPLICABLE LEGISLATION - JURISDICTION This agreement is subject to French law. In the event that a dispute arises as a result of this contractual relationship, the user and Pascal Boyart undertake to seek an out of court solution before instigating legal proceedings. In the event of a dispute, you can go to the office of the court nearest to your home.
